CRM-M-35675-2022 This petition has been filed under Section 482 Cr.P.C. for issuance of direction to respondents No.1 to 3 to investigate case FIR No.29 dated 28.01.2022 under Section 302 IPC, registered at Police Station Bawani Khera, District Bhiwani, in accordance with law. Learned counsel for the petitioner has submitted that the offence alleged by the petitioner-complainant amounts to Section 302 IPC, however, the investigating agencies have not proceeded with the investigation. Notice of motion was issued and this Court directed learned State counsel to file the status report.

Learned State counsel, on instructions from SI Pawan, has submitted before this Court that status report has already been filed wherein, DINESH BANSAL 2023.04.19 17:03 I attest to the accuracy of this order Chandigarh

CRM-M-35675-2022 (O&M) -22023:PHHC:054196 it has been stated that detailed investigation has been carried out in the FIR and after conducting the same, no cogent evidence was found and thus, cancellation report has been prepared. However, he submits that the same is not yet filed before the Court of competent jurisdiction. In view of above, the present petition is disposed of with a direction to the respondent-State to file the cancellation report as recommended before the Court of competent jurisdiction within two weeks from today.

Learned trial Court concerned would hear the same after issuing notice to the petitioner-complainant and the petitioner is at liberty to raise his grievance there in accordance with law.
