IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

FAO-1509-2007 (O&M) Date of decision: April 18, 2023 Sant Lal ....Appellant versus Anil Kumar and others ....Respondents CORAM: HON'BLE MR. JUSTICE ARUN MONGA Present:- Mr. J.P. Sharma, Advocate for appellant.

Ms. Shamsher Kaur, Advocate for respondent No.3-Insurance Company.

***** ARUN MONGA, J. (ORAL) Appellant before this Court is claimant assailing impugned Award dated 28.10.2006 passed by learned Motor Accidents Claims Tribunal, Narnaul (for brevity, 'Tribunal') whereby, claim petition of appellant/ claimant seeking compensation on account of injuries sustained by him allegedly in a road accident, was dismissed.

2.

Appeal was filed in the year-2007 and even paper-book of the case file got burnt in a fire accident which occurred in the High Court in the year-2011 and matter is being heard through whatever available record based on photocopies of the burnt file. In course of hearing, on a Court query, learned counsel for appellant candidly states that he is not in touch with his client and his repeated endeavors to seek instructions have been futile.

3.

In the premise, it appears that by sheer effluxion of time, appellant has lost interest in pursuing the matter and he seem to have moved on in his life, having recovered from injuries suffered in the accident in question. 4.

Be that as it may, instant appeal is dismissed for non-prosecution with liberty to file application in case, appellant contacts his counsel. MAHAVIR SINGH 2023.04.19 16:18 I attest to the accuracy and authenticity of this order/ judgment
