On our asking, Mr.Anil Mehta, learned Deputy Advocate General, Haryana, accepts notice on behalf of the respondents.
Let four copies of the writ petition be supplied to the State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution. In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from the respondents at this stage.
The petitioners claim themselves to be residents of village Dhorka, Tehsil and District Gurgaon. They have alleged that their names have always found mentioned in all the previous electoral rolls of the above-mentioned village but in MOHINDER KUMAR 2015.10.08 11:44 I attest to the accuracy and authenticity of this document Chandigarh
CWP No.21304 of 2015 [2] the revised voter list recently published for ensuing Gram Panchayat elections, their names are missing. Reliance is also placed on one of the latest voter list published on 21.01.2015 (P-1) to claim that petitioners' names were duly included in the electoral roll prepared for legislative constituency of Badshahpur in which their village falls.
The petitioners represented the authorities on 18.09.2015 (P-3) against non inclusion of their names in the voter list of village Dhorka.
Since various documents have been placed on record by the petitioners in support of their claim, we dispose of this writ petition with a direction to the Deputy Commissioner-cum-District Election Officer, Gurgaon, to verify the same; take an appropriate decision within one week and if the petitioners' claim merits acceptance and there is no legal impediment, let the needful be done within that period. Ordered accordingly.
