Learned counsel for the petitioner-institution submits that the petitioner-institution is not amenable to the jurisdiction of the educational Tribunal and hence, without considering the said fact, the impugned order dated 03.08.2015 (Annexure P-1) has been passed by the Tribunal. 2.

Faced with this situation, learned counsel for the respondents submits that liberty be given to the respondents to avail appropriate remedy before the appropriate Forum for the redressal of their grievance so as to get the salary which is admissible to the respondents from the petitionerinstitution by adopting the appropriate method. 3.

Learned counsel for the respondents further submits that no objection qua expiration of limitation period will be taken by the petitionerinstitution in case, the respondents approach the appropriate Forum for the redressal of their grievance.

Keeping in view the above facts and circumstances of the present case, the impugned order dated 03.08.2015 (Annexure P-1) is hereby set-aside.

However, the respondents will be at liberty to avail the appropriate remedy before the appropriate forum for the redressal of their grievance and in case, any such remedy is availed by the respondents then no objection qua the limitation will be raised by the petitioner-institution as the respondents were availing the remedy before a wrong Forum. 6.

The present petition is disposed of in above terms. 7.

Pending civil miscellaneous application, if any, stands disposed of.
