**** SANJAY VASHISTH , J. (Oral) CRM-43786-2022 This is an application for withdrawal of the criminal appeal (CRA-S-2122-SB-2006), as the same has been rendered infructuous on account of quashing of the proceedings ordered by this Court by virtue of compromise.
Notice.
On asking of the Court, Mr. Anmol Singh Sandhu, AAG, Punjab, who is present in Court, accepts notice on behalf of the respondent (State). Copy of the application has already been supplied to him by learned counsel for the applicant-appellant(s).
Counsel for the applicant-appellants points out that proceedings were quashed by this Court vide order dated 08.05.2018, passed in compromising quashing petition i.e. CRM-M-49520-2018. In view of said fact addressed by counsel for the applicantappellants, non-applicants/respondents does not raise any objection in KAVITA NAIN 2023.01.30 16:29 I attest to the accuracy and integrity of this document order/judgment
CRA-S-2122-SB-2006(O&M) - 2 - allowing the prayer addressed by the applicant-appellants. Accordingly, present application is allowed and same stands disposed of.
CRA-S-2122-SB-2006 Counsel for the appellants states that main case i.e. CRA-S2122-SB-2006 is listed for hearing on regular board of this Court at Sr. No.1249, therefore, he prays that same be taken up for its hearing and disposal, today itself.
Request made by counsel for the appellants is accepted, as the same is not opposed by learned State counsel also. In view of the statements of the counsel for the parties, main appeal is taken up for hearing today itself i.e. 30.01.2023. In view the averments made in the application (CRM-437862022), and the order passed therein, and the fact that proceedings have already been quashed by this Court in CRM-M-49520-2018 based upon the compromise, present appeal has been rendered infructuous, and stands disposed of.
