(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.169 dated 28.08.2020 under Sections 420, 467, 468, 471, 506, 120-B IPC registered at Police Station City Gurdaspur, Counsel for the petitioner herein would contend that the petitioner has been falsely implicated in the instant case. The petitioner and the complainant were known to each other as being retired from the Indian Army and had money transactions between them on many occasions earlier. It is further contended that at the best, it is a civil dispute, which have been given a colour of criminal case. The investigation is complete and the challan stands presented, therefore, prays for concession of bail to the petitioner.

Learned counsel appearing for the respondent-State opposes the bail application by submitting that no ground is made out for grant of bail to the petitioner.

CRM-M No.33564 of 2020 (O&M) -2Keeping in view the fact that the investigation is complete and challan has been presented and therefore, custodial interrogation of the petitioner would not be required, coupled with the fact that the trial is likely to take some time to conclude, no useful purpose would be served in keeping the petitioner behind the bars. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
