The petitioner has approached this Court under Articles 226/227 of the Constitution of India, seeking quashing of impugned order dated 09.11.2015 (Annexure P-8) passed by respondent No. 2 whereby appeal filed by the petitioner for waiving the interest was dismissed. 2.

After arguing for some time, learned counsel for the petitioner submitted that certain questions of fact are involved in this case which are required to be established by leading cogent and convincing evidence. Accordingly, a prayer has been made that he may be allowed to withdraw the instant petition, with liberty to the petitioner to approach the Civil Court for redressal of its grievance.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies, as may be available to it, in accordance with law.
