(ORAL ) Grievance of the petitioner who is posted as Hindi Mistress is against order dated 5.3.2019 (Annexure P3), vide which she has been transferred from GSSS Burj Sidhwa, Sri Muktsar Sahib to GSSS Chughe Kalan, Bhatinda being in violation of principles of natural justice as well as in contravention to Notification dated 9.10.2018 (Annexure P1) and Transfer Policy dated 6.2.2018 and 23.4.2018 (Annexure P7). Transfer, in fact, being a matter of administrative exigencies, this Court generally refrains from interfering in the same. CWP-19394-2019 Accordingly, while the prayer of the petitioner to quash her transfer order dated 5.3.2019 (Annexure P3) is declined as I see no ground to interfere in the extra ordinary writ jurisdiction of this Court. However, while disposing of the writ petition, I may like to observe that the respondents have passed speaking order dated 01.07.2019, as reflected from Annexure P5, in the case of similarly situated teachers, though the same was under directions of this Court as they had approached by filing CWP No.6521 of 2019, for mitigation of their grievances and the said petition was disposed of directing the respondent to pass appropriate orders within 3 weeks by maintaining the status quo of their transfer.
In the premise, without commenting on the merits of the case, it is expected that the respondents would accord similar treatment to the petitioner by passing appropriate speaking order after objectively considering the request dated 03.07.2019 submitted by the petitioner (Annexure P6), as also the contentions raised in the present writ petition by treating the same as a supplementary representation and pass a speaking order, in accordance with law.
Let the needful be done within a period of four weeks from the date of receipt of a certified copy of this order. Disposed of in above terms.
