The instant petition has been filed for quashing of impugned order dated 15.11.2023 (Annexure P-1) passed by learned Judicial Magistrate 1st Class, Faridkot whereby the petitioners were declared as proclaimed offenders.

Learned counsel for the petitioners contended that a compromise has been effected between the parties and the petitioners have already paid the compromised amount to the private respondents. 3.
Notice of motion.

Mr. Subhash Godara, Additional Advocate General, Punjab, accepted the notice on behalf of respondents-State and contended that the petitioners are declared as proclaimed offenders in the year 2023 i.e. two years back and still they are living abroad. Learned counsel further submitted that since sufficient amount has been spent by the State for proceedings of the present case, so a heavy cost may be imposed upon the petitioners.

Mr. L.S.Lakhanpal, Advocate has filed his vakalatnamas on behalf of respondents No.2 and 3 which are taken on record. He has admitted the factum of compromise effected between the parties and submitted that the complainant has no objection if impugned order is quashed.

Keeping in view the above facts and circumstances of the present case as the main complaint has already been compromised between the parties, no useful purpose will be served by keeping the proceedings pending, so the impugned order dated 15.11.2023 (Annexure P-1) is hereby quashed subject to costs of Rs.1,20,000/- (Rupees One Lakh Twenty Thousand only) to be deposited with Poor Patient Welfare Fund, PGIMER, Chandigharh. Copy of receipt be produced before trial Court. 7.
Disposed of.
