Prayer in this writ petition is for issuance of direction to the respondents to release GPF amount and interest on the delayed payment of retiral benefits, stated to be due to the petitioner. Learned counsel for the petitioner submits that petitioner retired as Social Education and Panchayat Officer on 31.10.2018 from the respondent-Department. It is submitted that gratuity amount and arrears of pension was credited in the petitioner's account on 20.11.2019 with the same being sanctioned on 05.09.2019. Thereafter, leave encashment and GIS amount was paid to the petitioner on 17.05.2021, however, in spite of passage of almost four years, GPF amount has not been paid to the petitioner in an illegal and unjustified manner. It is further submitted that gratuity, leave encashment, GIS and arrears of pension which were paid to the petitioner after more than one year, have been released without interest to which petitioner is rightfully entitled to. Learned counsel submits that in this respect legal notice dated 15.07.2022 (Annexure P-3) was also served but to no avail.

CWP-17384-2022 -2At this stage, learned counsel for the petitioner restricts the prayer for a decision on the legal notice dated 15.07.2022 (Annexure P-3), in a time bound manner.
Keeping in view the facts and circumstances of this case, but without any expression of opinion on the merits of the matter, this petition is disposed of with a direction to the competent authority to consider and decide petitioner's legal notice dated 15.07.2022 (Annexure P-3), by passing a speaking order, in accordance with law, within a period of three months from receipt of certified copy of this order. In case, petitioner is found entitled to any monetary benefits, same be released within the next two months thereafter.
Writ petition is disposed of accordingly.
