Lakshey Kumar v. State Of Punjab And ORS
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH CWP No. 16880 of 2017 Date of decision : 23.10.2018 Lakshey Kumar ....Petitioner V/s State of Punjab & ors.
....Respondents BEFORE : HON'BLE MR. JUSTICE RAJAN GUPTA
Present:
Mr. Tribhawan Singla, Advocate for the petitioner. RAJAN GUPTA J.
Petitioner has prayed for a writ in the nature of certiorari for quashing order dated 02.08.2016, Annexure P-4 whereby his plea for appointment on compassionate grounds has been rejected. As per averments made in the petition, mother of the petitioner was working as steno typist in the office of District Manager, Markfed, Sangrur. She died on 09.06.1999. An FIR No. 124 was registered under sections 304-B, 306 IPC against father of the petitioner. Petitioner earlier preferred CWP No. 23795 of 2011 for release of pensionary benefits and this court had directed the pensionary benefits to be paid to the petitioner. Admittedly, he is regularly getting the pensionary benefits. As mother of the petitioner died way back in the year 1999, the appointment of compassionate ground at this stage is misconceived. Neither any statutory provisions nor Rules/Regulations have been pointed out which entitle petitioner for such an appointment. There is no merit in the petition. Same is hereby dismissed.
