Learned State counsel has filed custody certificate and has opposed the prayer for bail on the ground of serious nature of allegations. 5.
Investigation of the case is complete. Petitioner is in custody for the last more than 4 months. Truth of the allegations against him can be determined only on conclusion of trial. No prosecution witness has yet been examined and conclusion of trial is likely to take time. Though there is one criminal case registered against the petitioner, that alone cannot be a ground to refuse bail. Considering the period of incarceration but without commenting on merits, petitioner is ordered to be released on regular bail subject to his furnishing adequate bail and surety bonds to the satisfaction of trial Court/Duty Magistrate.
All the pending miscellaneous applications, if any, stand disposed of.
