The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside of result of draw of lots dated 24.11.2022 by which respondent No.3 has been declared successful candidate for allotment of Petrol Pump.

Learned counsel for the petitioner Inter alia contends that petitioner and respondent No. 3 belongs to Scheduled Caste category and they had applied for dealership of respondent-Corporation pursuant to advertisement of the Corporation. The respondent-Corporation has declared respondent No.3 as successful candidate even though he is not holding valid lease deed as it has not been signed by all the owners of the land. Mr. Ashish Kapoor, Advocate, who on advance notice is present in Court on behalf of respondents No. 1 & 2 submitted that respondent-Corporation has replied to the legal notice of the petitioner which has not been challenged.

On being confronted with the aforesaid fact, learned counsel for the petitioner seeks permission to withdraw the writ petition with liberty to file a fresh with better particulars.
