The petitioner apprehending arrest in the FIR captioned above, had come up before this Court under Section 438 CrPC seeking regular bail. 2.

Vide order dated 09.08.2023, the petitioner was granted interim protection, which is continuing till date. On 14.09.2023, interim order was extended subject to compliance of certain conditions.

Counsel for petitioner submits that the petitioner has voluntarily complied with the order dated 14.09.2023 and handed over affidavit to the State counsel. He further submits that the incident pertains to the year 2007-2014 and then the petitioner was working as District Education Officer at Gurdaspur. The allegations against the petitioner are that some forged documents were explained as correct. The FIR was registered in the year 2023.

Since the petitioner is a woman of age 63 years and has retired from service in the year 2013 and the incident took place in the year 2014 which was only for the recruitment process that has been started, there would be no reason to deny the bail. Given above, petition is allowed and interim order dated 09.08.2023, is made absolute. Pending applications if any, stand disposed of. It is clarified that in case petitioner fails to join the investigation as and when called by the Investigating Agency, State shall file application for cancellation of her bail and only on this ground alone, the bail will be cancelled.
