Present civil revision has been filed under Article 227 of the Constitution of India for issuance of appropriate directions to the learned Executing Court, Karnal to decide the execution petition (Annexure P-3) in a time bound manner.

Learned counsel for the petitioner has submitted that the third party objectors are delaying the proceedings. It is further submitted that on 27.01.2026 when the case was fixed for evidence of third party objector, he moved an application for consolidation of cases to which on the next date itself the petitioner/decree holder filed a reply. It is, however, submitted that more than six dates have passed by, but the said application has not been decided. It is stated that the application for consolidation of cases is now fixed for 09.07.2026 and the petitioner NARESH KUMAR 2026.05.26 14:33 I attest to the accuracy and integrity of this document/judgement

CR-4441-2026 -2undertakes to argue the said application on the next date of hearing. It is further stated that the executing court be directed to decide the application on the said date or within some time from the next date. It is prayed that even the third party objections be decided expeditiously. 3.

Keeping in view the above-said facts and circumstances, more so, the fact that the execution is pending since 2023, the Executing Court is requested to decide the application for consolidation of cases filed by respondents No.1 and 2 on 09.07.2026 or within a period of 15 days therefrom. The Executing Court is further requested to decide the third party objections and also the main execution petition, as expeditiously as possible.

All the counsels appearing before the concerned Court are also requested to fully assist the Court in the expeditious disposal of the said application.
