Dated Police Station Sections 19.01.2023 Taraori, District Karnal, Haryana 365 IPC (346 IPC deleted) Seeking quashing of above captioned FIR, petitioner has come up before this Court by filing the present petition under Section 528 BNSS 2023. 2.
Petitioner is seeking quashing of FIR on the ground that complainant was under pressure of her parents at the time of recording of statement and the pressure was so much that she was compelled to make wrong statement even before the concerned Judicial Magistrate recorded under Section 164 CrPC. Counsel for the petitioner submits that victim is legally wedded wife of petitioner and after their marriage, they also sought protection from this Court 3.
On instructions from ASI Sukhwinder Singh, counsel for the State submits that once the statement has been recorded before the Judicial Magistrate, it cannot be denied and based on the material evidence against the petitioner, challan against him has been filed.

Counsel for the petitioner submits that he will explore possibility of compromise with the victim and if the compromise happen he be permitted to file joint petition for quashing of FIR on the basis of compromise and in case compromise does not happen he be permitted to take all these points, which are taken up before this Court, before ANJU RANI 2025.09.11 11:27 I attest to the accuracy and integrity of this document Punjab and Haryana High Court Chandigarh

Given above, present petition is disposed of with the following directions:- (i) Before framing of charges appropriate opportunity be given to the petitioner to raise all his points and refer to any documents which shall be considered in accordance with law by the trial Court. (ii) In case, the petitioner is able to enter into some kind of compromise with the victim/complainant, then he shall be at liberty to file a fresh joint petition or petition on the basis of compromise.
