Petitioner-Abhishek Vohra has filed the instant petition under Section 528 of BNSS, for seeking permission to travel abroad i.e. USA from 03.06.2026 to 25.06.2026. Petitioner's return flight is scheduled via Canada. 2.

Vide order dated 27.03.2026 passed by this Court in CRM-M16761-2026, on registration of FIR No.21 dated 12.02.2026 under Sections 318(4), 61(2) of BNS (Sections 420 and 120-B IPC), Police Station Kalanaur, District Gurdaspur, petitioner was granted interim anticipatory bail by this Court.

On joining investigation and submission of the Passport to the Investigating Officer, said interim bail was confirmed, vide order dated 05.05.2026 (Annexure P-3).

On hearing learned senior counsel for the petitioner, following

CRM-M-28664-2026 (O&M) 2 was recorded on 20.05.2026:- "i) xxx ii) xxx iii) xxx iv) Learned senior counsel further refers to the Export Licence dated 05.12.2025 (P-6), issued in favour of the petitioner's firm, namely M/s A.G. Rice Mills, by the office of the Directorate of Plant Protection, Quarantine and Storage, NH-IV, Faridabad, Haryana, and submits that petitioner is required to visit the USA for the aforesaid period in connection with export dealings in rice. It is further submitted that petitioner is ready and willing to abide by any terms and conditions that may be imposed by this Court. v) Notice of motion.

vi) Mr. Neeraj Madaan, learned Senior DAG, Punjab, appears on behalf of the respondent-State and seeks some time to verify the contentions and submissions recorded hereinabove.

Today, short reply dated 29.05.2026, being filed by learned State counsel is taken on record. Registry to tag the same at an appropriate place. Paragraphs No.5, 6, 7, 8 and 9 of the short reply read as under:- "5.

That it is humbly submitted that the in compliance of the order passed by this Hon'ble Court in CRM M No.16761 of 2026, the petitioner has en joined the investigation on 01.05.2026 and passport of the petitioner in the possession of the investigating officer in view of the directions of Hon'ble Court. The case is under investigation. 6.

That it is humbly submitted that during the verification of the SHO, Police Station Kalanaur, the petitioner and his mother is owner of the M/s A. G. Rice Mills, Amritsar. The Export Licence dated 05.12.2025 (Annexure P-6) is found to be correct.

That it is submitted that the petitioner's visit to abroad is for business purpose.

That it is humbly submitted that according to his latest passport No. S-1782928, the petitioner had earlier visited three countries i.e UAE in the year 2019, 2020 and 2022, Oman in the year 2019 and 2024 and Thailand in the year 2023 and 2025.

That it is humbly submitted that during the verification the tickets are found to be correct."

Dy. S.P. Amlok is also present before this Court during the arguments addressed by both the counsel.

Considering all the circumstances highlighted in the petition and also recorded in order dated 20.05.2026, having been confirmed by the reply dated 29.05.2026 by the respondent-State, this Court deems it appropriate to allow the instant petition. The Investigating Officer is directed to hand over the original Passport to the petitioner enabling him to join his business meetings/ functions which, as stated are due to be performed from 03.06.2026 to 25.06.2026 in United States of America, subject to furnishing of FDR for an amount of Rs.10 Lakhs, as security, by the petitioner before the Area Magistrate. However, after return, petitioner would surrender his Passport to the Investigating Officer or the Court concerned, wherever on that day, proceedings would be pending.
