IN THE HIGH COURT FOR THE STATES OF PUNJAB AND

HARYANA AT CHANDIGARH CWP No.22191 of 2014 Date of Order: 16.11.2016 Vikas Mittal and Ors.

....Petitioners

Versus

State of Punjab and Ors.

....Respondents CORAM: HON'BLE MR. JUSTICE JASWANT SINGH

Present:

Mr. Ashok Kumar Nabhewala, Advocate for the petitioners.

Mr. Harkesh Manuja, Addl.A.G, Punjab for respondent Nos.1 & 2.

None for respondents no. 3, 6 to 10, 15, 16, 22, 26, 34, 37 (earlier Mr. Anshuman Chopra, Advocate appeared on their behalf) None for respondents no. 12, 19, 21, 29, 33, 35, 36,39. (earlier Mr. Karanjit Singh, Advocate appeared on their behalf) None for respondent no.25 (earlier Mr. Ravinder Kumar, Advocate appeared on his behalf) JASWANT SINGH, J (ORAL) The four petitioners, namely, Vikas Mittal, Parveen Rani, Rupinder Singh and Rekha have laid challenge to the selection/appointment of private respondent Nos.3 to 39 as Medical Laboratory Technicians Grade-II pursuant to 390 such posts advertised on 26.7.2011.

The primary basis is that the private respondents do not possess the minimum stipulated basic qualification of 10+2 with Science, hence their selections are liable to be set aside and the petitioners being next in the merit list are entitled to be appointed.

CWP No.22191 of 2014 #2# At the time of hearing, learned counsel for the petitioners points out that Vikas Mittal, Parveen Rani, Rupinder Singh, petitioner Nos.1 to 3 respectively have since been issued appointment letters and, therefore, the present writ petition qua them have become infructuous and that as regards, petitioner No.4-Rekha, he does not press the petition praying that the same may be dismissed as withdrawn.

Learned state counsel does not dispute the aforesaid fact.

In view of the above, present writ petition is dismissed as infructuous qua petitioner Nos.1 to 3 whereas it is dismissed as withdrawn qua respondent No.4.
