(ORAL) The claim of the petitioner in the present writ petition for the issuance of the directions to the respondents to release his salary for the period from 01.06.2018 to 31.05.2019.

Counsel for the petitioner argues that petitioner, who was holding the post of Deputy Labour Commissioner on the date of his superannuation, was re-employed to hold the same post for one year i.e. from 01.06.2018 till 31.05.2019. Counsel further argues that petitioner satisfactorily performed his duties for the said period of one year, but no salary has been paid to him for the said period though he has already superannuted on 01.06.2019. Counsel prays that a direction be issued to respondents for the release of the salary.

Counsel for the petitioner states that for the relief which has been sought in the present writ petition, petitioner has submitted the representations dated 31.05.2019 and 28.06.2019 (Annexures P-4 and NARESH KUMAR 2019.07.23 15:37 I attest to the accuracy and integrity of this document Chandigarh

CWP-19336-2019 -2P-5) respectively, which are still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said representations.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the representations dated 31.05.2019 and 28.06.2019 (Annexures P-4 and P-5) respectively by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of three months thereafter. Present writ petition stands disposed of.
