The petitioner has prayed for a direction to respondent No.2 to take appropriate action against the private respondents and respondent No.3, who has allegedly favoured them in closing the case of the petitioner. It is alleged that in the initial inquiry conducted by respondent No.3 on 14.11.2014, recommendation was made to initiate action against the private respondents but on the basis of an inquiry report of respondent No.3 dated 29.03.2015 in which he had found that there was no mensrea and recommended to file the complaint, the Deputy Superintendent of Police, Circle Amloh has filed the complaint vide order dated 06.04.2015. After hearing learned counsel for the petitioner and examining the record, I am of the considered opinion that the petitioner has an alternate remedy under the Code of Criminal Procedure, 1973 and as such, no direction is required to be issued in the present case.
