RAMESHWAR SINGH MALIK, J.(Oral) Feeling aggrieved against the alleged inaction on the part of the respondent authorities, petitioner has approached this Court, by way of instant writ petition under Articles 226/227 of the Constitution of India, seeking a writ in the nature of Mandamus, directing the respondent authorities to implement the directions, as mentioned in the order dated 12.05.2011 (Annexure P-3) passed by the Additional Registrar (Marketing) Cooperative Societies, Haryana.

Notice of motion was issued. However, no reply has been filed.

Heard learned counsel for the parties.

notification dated 06.06.2016, issued by the Additional Chief Secretary to Government of Haryana, Cooperation Department, Chandigarh, whereby a Commission has been constituted to resolve the long outstanding issues pertaining to membership and assets of Saraswati Kunj Cooperative House Building Society Civil Line, Gurgaon-respondent No.3. Learned counsel for respondent No.3 is well justified in contending that let present petition be also referred to the same Commission, who is already seized of the matter.

Learned counsel for the petitioner also fairly states that present writ petition be disposed of, in terms of the statement made by learned counsel for respondent No.3, referring this case to the same Commission, who is looking into the outstanding issues pertaining to the respondent-Society.

In view of the above said fair statements made by learned counsel for the parties, present writ petition is disposed of referring this case to the Commission constituted vide abovesaid notification dated 06.06.2016. The Commission, who is already seized of the matter, shall also look into the claim and grievance raised by the petitioner, by passing an appropriate order, in accordance with law. With the abovesaid observations made and directions issued, present writ petition stands disposed of.
