On the basis of the aforesaid concluded enquiry, the Chief Vigilance Officer submitted his report on 30.11.2015 recommending that the complaint be consigned.

Learned counsel for the petitioner submits that the requisite approval of the Government is still pending and in this regard, invited the attention of this Court to page 67 of the paper book.

I have perused the said page of the paper book and it is evident that the matter is still pending for Government approval. However, a reply by way of an affidavit has been filed for and on behalf of the Government in the present case, hence, in such circumstances it has to be presumed that the vigilance enquiry has been accorded approval by the Government and has attained finality. 7.

In view of the above, since the vigilance enquiry already stands concluded and the limited prayer in the present petition was only to the extent that the respondents be directed to conclude the investigation, hence no cause of action survives for consideration by this Court.
