G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the relief of a decision on the legal notice dated 20.08.2015 (Annexure P-3), which has been served upon respondent no. 2.
The dispute pertains to family pension of the deceased namely Jagwinder Singh, who is the son of the petitioner, who while working as Clerk in the Civil Court, Ludhiana, died on 12.03.2011 and was unmarried. It is the case of the petitioner that on 13.05.2011, the District and Sessions Judge, Ludhiana had written to the Deputy Commissioner for verification of the income of the petitioner for family pension and the list of dependents was also given. The SDM, Raikot had given a positive report in favour of the family but respondent no. 2 has not processed the case thereafter. Counsel submits that he would be satisfied at this stage if a direction is issued to the respondents to take a decision on the said legal notice within a time bound frame.
Keeping in view the limited relief sought, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the legal notice dated 20.08.2015 (Annexure P-3) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons. 08.10.2015 (G.S.
