ALKA SARIN, J.: (Oral) Heard through video conferencing.
This is a petition under Section 482 of the Code of Criminal Procedure, praying for quashing of the Parwana i.e.
summons/information letter dated 05.10.2020 as well as for directions to the official respondent Nos.1 to 4 to take action on the representation dated 10.08.2020 and further to provide security to protect the life and liberty of the petitioner.
Learned counsel for the petitioner has contended that the petitioner had given a representation dated 10.08.2020 on which no action has been taken till date and thereafter he has received an information letter dated 05.10.2020 asking him to come present in Police Station Sector-19, Thana Old Faridabad on 11.10.2020 at 11.00 am. CRM-M No.34749 of 2020 (O&M) -2Notice of motion.
On the asking of the Court, Ms. Dimple Jain, Assistant Advocate General, Haryana, has put in appearance. On instructions from Inspector Arjun, she has stated that the information letter dated 05.10.2020 has been issued merely for calling the petitioner to come present in the police station for assisting the investigating officer in investigating the matter. It has further been stated on instructions from Inspector Arjun that both the complaints i.e. one made by the petitioner as well as one made by the complainant/respondent No.6, are being looked into simultaneously. He has further assured that there would be no danger to the life and liberty of the petitioner.
In view of the above, no further order need to be passed. There is no question of quashing of the summons/information letter at this stage inasmuch as that is only a letter of information asking the petitioner to come present for further investigation and does not call for interference by this Court.
In view of the above, the present petition is disposed off on the basis of the statement made by the State counsel. (ALKA SARIN) JUDGE 30.10.2020 ps-I NOTE:
