The revisionists, who are defendants/counter claimants, in the civil suit pending before Civil Judge (Junior Division), Bathinda, are feeling aggrieved by the impugned order dated 8.9.2021, vide which their evidence has been closed by order. I have heard learned counsel for the revisionists, besides going through the record.

The case in hand has been made time bound by the Apex Court vide order dated 22.2.2021, to be decided within nine months i.e. upto 22.11.2021. In the impugned order, it has been mentioned that despite being given five opportunities, respondents No. 4 to 7 have failed to bring any evidence, as such their evidence was closed BANITA CHUGH 2021.09.17 16:11 I agree to specified portions of this document

C.R. No. 1959 of 2021 -2by order. Though, I do not find any illegality or infirmity with such order, however, in the interest of justice, to ensure that such respondents are not deprived of a reasonable opportunity to produce their evidence in support of their case, it is ordered that one opportunity for leading evidence may be given to such respondents. The respondents shall bring such evidence at their own responsibility on that date and no further adjournment for the purpose shall be granted. This opportunity is being given subject to payment of Rs.10,000/- to be deposited with District Legal Service Authority, Bathinda. The trial Court shall fix a date for that purpose, on submission of receipt with regard to deposit of costs. Disposed of.
