This is a civil writ petition filed under Articles 226/227 of the Constitution of India for issuance of a writ in the nature of mandamus directing the respondents to grant 4 year proficiency step up increment to the petitioner w.e.f. 06.12.2015 and to release the arrears in this regard. 2.

Learned counsel for the petitioner submits that the District Controller, Department of Food, Civil Supplies and Consumer Affairs, Gurdaspur has already recommended for granting 4 years step up promotion to the petitioner. The service details have also been forwarded but no decision is being taken at the level of the Department. A legal notice dated 16.03.2023 (Annexure P-9) was also served but the same has remained unanswered. The petitioner, as per his service record, is entitled for 4 years proficiency step up.

I have heard learned counsel for the petitioner at length and have considered the submissions.

Taking into consideration the documents which have been placed on record and the fact that the legal notice has already been served upon the respondents, it is directed that the respondents shall take steps to decide the legal notice dated 16.03.2023 (Annexure P-9) and pass a speaking order. The said exercise shall be done as expeditiously as possible, preferably, within a period of three months from today. 5.
