The petitioners are aggrieved against the order dated 06.06.2018 passed by respondent No.2, whereby interim stay granted during pendency of the appeal, in the proceedings initiated by the Gram Panchayat, under Section 11 of the Punjab Village Common Lands (Regulation) Act, 1961, was vacated.

Interim stay was granted to the petitioners by the Appellate Authority on 02.05.2018 till 11.07.2018, i.e. the next date of hearing fixed. However, the case was taken up on 06.06.2018 on an application filed by the Gram Panchayat for pre-ponement. On that day, the interim stay was vacated. However, the main appeal was again kept for 11.07.2018. Now the matter stand adjourned to 30.10.2018.

CWP-15453-2018 (O&M) -2Notice of motion in the present petition was issued on 15.06.2018 for 19.07.2018 and dispossession of the petitioners was stayed. Learned counsel for the Gram Panchayat submitted that the petitioners had been dispossessed from the land in their possession on 15.06.2018.

This fact has been disputed by learned counsel for the petitioners.

In view of the aforesaid factual matrix, we direct the parties to maintain status quo till decision of the appeal by the Appellate Authority, which is now listed on 30.10.2018. The Appellate Authority shall endeavour to dispose of the appeal on the next date of hearing fixed or immediately thereafter without any further delay.
