State of Punjab and others ..............Respondents Coram:
Hon'ble Mr.Justice Jaswant Singh Present:- None for the petitioner.
Ms.Anu Chatrath Kapur,Addl.AG Punjab with ASI Gurmukh Singh, ASI PS City Patti,Tarn Taran. Ms.Ramandeep Kaur,Advocate for Ms.Sumeet Goel,Advocate for CBI.
Jaswant Singh,J,(Oral).
Petitioner Gurmukh Singh is father of complainant-Kirandeep Kaur, who was stated to be around 22 years of age when she lodged FIR No.77 dated 7.5.2014 under Sections 366/376 (D) IPC at PS Patti,Distt. Tarn Taran against her husband Satnam Singh son of Jagir Singh alongwith his friends. She also lodged another FIR No.148 dated 21.5.2015 under Section 365 IPC, PS Patti District Tarn Taran against Satnam Singh, her estranged husband, for kidnapping and compelling her to withdraw her previous FIR. Since no worthwhile investigations were being conducted and Satnam Singh was not arrested, the father of the prosecutrix i.e. the petitioner, filed the present petition under Article 226 of the Constitution seeking change of investigating agency to properly investigate the allegations in the aforesaid two FIRs. This Court during previous date of hearing on 25.7.2018 passed the following order:- RAJINDER PARSHAD JOSHI 2018.08.09 17:22 I attest to the accuracy and integrity of this document
CWP 20743/2016 "Learned State counsel has stated on instructions from Rajesh Kakkar, SHO,PS Patti, Distt.Tarn Taran that the present petition has perhaps become infructuous because the prosecutrix has started living with the accused and has also submitted that the petitioner, who is father of the lady, has also given in writing to the SHO that he does not want to pursue the FIR. Be that as it may, since counsel for the petitioner is not present, therefore, hearing of this case is deferred to 9.8.2018.
To be shown in the urgent list."
None had appeared on behalf of the petitioner on the previous date of hearing. Same is the position today.
Learned State counsel on instructions from ASI Gurmukh Singh, PS Patti, Distt.Tarn Taran states that in the light of Kirandeep Kaurprosecutrix having resolved her matrimonial dispute with her husbandaccused Satnam Singh and started living with him in her matrimonial home, the petitioner has recorded his statement before the police that he does not wish to pursue the present writ petition.
It is for this reason perhaps that there is no representation on behalf of the petitioner.
In view of the aforesaid situation, no further adjudication is required.
Disposed of.
