CORAM:
HON'BLE MR. JUSTICE HARKESH MANUJA
Present:
Mr.Hemant Bassi, Senior Advocate with Ms. Gursimran Kaur, Advocate, Ms. Saloni Chhabra, Advocate, for the petitioners.
Mr. Abhinav Kalia, DAG, Haryana, for respondents No.1 & 3.
Mr. P.S. Saini, Advocate and Mr. Deepak Saini, Advocate, for respondent No.2-HSIIDC.
***** HARKESH MANUJA J. (Oral) 1.
By way of present revision petition, prayer has been made for issuance of direction to the learned Executing Court for expeditious disposal of execution petition.
2.
On 27.05.2026, this Court passed the following order:- "On 26.05.2026, this Court passed the following order:- "Ms. Sunita Badhran, DGM (Finance) HSIIDC, HO, Panchkula, who is present in Court, states that the calculations in support of the reply already submitted with the Registry of the concerned Executing Court on Friday i.e. (22.05.2026), in addition, shall be filed before the Registry of the said Court, latest by
--2-- tomorrow i.e. 27.05.2026 through Sh.Ashok Yadav, Engineering Incharge of Dharu hera, and copy thereof shall be furnished to the learned counsel for the petitioners in Court on the next date of hearing in the present proceedings.
List on 27.05.2026.
Be shown in the urgent list, henceforth."
In terms thereof, a calculation sheet, duly signed by Ms. Arti Bansal, Manager (Legal), HSIIDC and Mr. Deepak Saini, Advocate, has been handed over in Court today, the same is taken on record as Mark 'X'.
A perusal thereof shows that no details whatsoever have been provided in the said calculations with respect to the amount of market value, benefits under Sections 23 1-A and Section 23 (2) of the Land Acquisition Act, 1894, (for short 'the 1894 Act') or even the date on which the amount under the original award was released in favour of the petitioners/ landowners. Similar is the position with respect to the calculations made in terms of the decisions rendered by the learned Reference Court, this Court or even by the Hon'ble Apex Court.
In such circumstances, it appears that the respondents are deliberately and consciously delaying to disburse the compensation in favour of the petitioners/ landowners. The above said calculations have been handed over by Ms.Arti Bansal, Manager (Legal), HSIIDC, who is present in Court, and the same were, in turn, provided by Mr. Ashok Yadav, AGM Engineering, HSIIDC, and Ms.Pooja Batra, AGM, Accounts, Field Office, Babal.
In the wake of above, the above said two officers i.e. Mr. Ashok Yadav, AGM Engineering, HSIIDC, and Ms.Pooja Batra, AGM, Accounts, Field Office, Babal, are saddled with costs of Rs.1,00,000/- to be paid in equal shares to the petitioners from their own pocket on next date of hearing.
Ms.Arti Bansal, Manager (Legal), HSIIDC, prays for a day's time to provide correct calculation sheet before this Court.
--3-- List on 29.05.2026.
In case of default, the Managing Director, HSIIDC shall remain present in Court on the date fixed.
Be shown in the urgent list, henceforth."
3.
Today, learned counsel appearing on behalf of respondent No.2HSIIDC, has produced before this Court a detailed calculation. A copy thereof has been supplied to the learned counsel for the petitioner. 3.1 Learned counsel for respondent No.2-HSIIDC assures that this calculation sheet shall also be submitted before the learned Executing Court by tomorrow.
4.

Accordingly, the present petition stands disposed of. The learned Executing Court is requested to decide the execution petition expeditiously preferably within next 30 days from the date fixed before it. 6.
Pending application, if any, also stands disposed of. 29.05.2026 (HARKESH MANUJA) sonika JUDGE Whether speaking/reasoned:
