**** AJAY KUMAR MITTAL, A.C.J. (Oral) The petitioner has approached this Court under Article 226 of the Constitution of India, seeking a writ in the nature of certiorari, for setting aide the impugned notice Annexure P-1, qua the petitioner's sole residential House i.e. H.No. 107, Sector 21-A, Chandigarh, which was got published by the respondent Bank in 'The Indian Express', on 04.05.2018. The said notice is stated to be violative of the mandatory provisions of Section 13 of the Securitization and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 (in short 'the SARFAESI Act'). A further prayer for staying the operation and implementation of the impugned notice Annexure P-1, has also been made. 2.
Learned counsel for the petitioner submitted that the auction has already taken place and therefore, the present writ petition has been rendered infructuous. In view thereof, it was prayed that he may be allowed to withdraw the present writ petition.
