The tenant/petitioner has filed the present revision petition against the concurrent finding of fact arrived at by the learned Rent Controller, affirmed in appeal by the learned Appellate Court ordering his eviction.

After arguing the revision petition at length, learned counsel for the petitioner, on realizing the difficulty in persuading the Court to take a different view, has come up with an alternative prayer. He submits that the petitioner may kindly be permitted to withdraw the present revision petition, provided he is granted sufficient time to relocate his business. Learned counsel for the respondent has contested the aforesaid prayer and submitted that the petitioner has already delayed the decision by seven years.

Civil Revision No. 4415 of 2019 (O&M) present revision petition is dismissed as withdrawn. The petitioner would file an undertaking before the learned Executing Court to handover the vacant possession of the tenanted premises on or before 31.08.2020 to the landlord. He would also clear all the arrears of rent and would also deposit, in advance, the rent payable upto 31.08.2020 within one month from today. The petitioner will also file an undertaking that he will not transfer the possession of the tenanted premises to anyone else. If the petitioner files an undertaking to that effect within 15 days from today, he shall be granted six months time to hand over the vacant possession to the landlord. The miscellaneous application(s), if any, shall also stand disposed of.
