Learned counsel for the parties are ad idem that the instant Letters Patent Appeal is liable to be disposed of in terms of the decision dated 11.12.2008 passed by a Coordinate Bench in LPA No.300 of 2008 and other connected appeals. The matter was adjourned sine die to await the decision of the Hon'ble Supreme Court in the SLP which was preferred against the above-cited order.

The Civil Appeal No.(s) 6750 of 2012 arising out of that SLP has since been dismissed by the Hon'ble Supreme Court on 09.02.2017.

In this view of the matter, the instant appeal is disposed of in terms of the above-cited order of the Coordinate Bench. ( SURYA KANT ) JUDGE June 02, 2017 ( HARI PAL VERMA ) meenuss JUDGE 1.
