(ORAL) This is a petition that has been filed for grant of regular bail in case FIR No.858 dated 12.12.2018 under Sections 171A, 406, 420, 467, 468, 471 and 120-B IPC registered at Police Station DLF 29, Gurugram, who is in custody since 22.02.2020 in the aforesaid FIR. Counsel for the petitioner herein would inter alia contend that the matter has already been investigated and challan presented, while submitting that the matter stands compromised between the parties namely Ramesh Bhati i.e.the main accused and the complainant, Jai Prakash Gupta. It is also argued that amount of Rs.4 lakhs, which is stated to have been received by the petitioner already stands reversed into the account of the complainant. It is further submitted that since the matter stands compromised with the main accused, custody of the petitioner would no longer be required.

I have heard learned counsel for the parties. Keeping in view the fact that the matter has been compromised between the main accused and the complainant and the amount of Rs.4 lakhs has already been reversed into the account of the complainant, this Court deems it appropriate to allow regular bail to the petitioner. The instant petition is allowed and the petitioner is directed to be released on regular bail on execution of adequate personal/surety bond to the satisfaction of concerned trial Court/Duty Magistrate. However, any observation made herein shall not be construed to be an expression on merits of the case.
