CHANDIGARH CWP No. 21741 of 2015 Date of decision: 09.10.2015 Parshotam Lal ....Petitioner(s)

Versus

State of Punjab and others

...Respondent(s)

CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA

Present:

Mr. Rohit Garg, Advocate, for the petitioner.

G.S.SANDHAWALIA, J. (Oral) The petitioner seeks release of the upgradation of his post from Veterinary Inspector to District Veterinary Inspector by implementing the letter dated 15.12.2011 and for release of relevant pay scale. It is the case of the petitioner that he was one of the senior most persons working on the post of Veterinary Inspector and the seniority list was released on 31.08.2011, in which he was figured at Sr. No. 23. One person at Sr. No. 3 namely Ashok Kumar retired on 01.10.2011 and, therefore, on account of the upgradation of 22 posts on 15.12.2011 which was carrying a grade pay of `4,800/- alongwith the pay band of `1030034800, he was entitled for the said benefit as he retired on 31.12.2011. Counsel submits that he has filed a representation dated 21.08.

2015 (Annexure P-9) upon the respondents for the necessary relief but no action has been taken on the same. Counsel submits that he would be satisfied at this stage if a direction is issued to the respondents to take a decision on the said representation within a time bound frame. Keeping in view the limited relief sought, this Court does not feel necessary to call upon the respondents to file reply. Accordingly, this writ petition is disposed of with a direction to respondent no. 2 to take into consideration the representation dated 21.08.2015 (Annexure P-9) and decide the same within a period of 3 months from the date of receipt of certified copy of the order. Needless to say that in case the relief is to be denied, the order should contain reasons. 09.10.2015 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2015.10.
