(ORAL) Instant writ petition has been filed for issuance of direction to respondents No.1 and 3 to ensure securing and submission of report of chemical examiner for the purpose of final decision in DDR No.22 dated 29.09.2014 under Section 174 of the Code of Criminal Procedure registered at Police Station Canal Colony, District Bathinda. Learned counsel for the petitioner contends that father of the petitioner, namely, Anil Kumar was working as Head Constable in the Police Department at Bathinda. He died on 29.09.2014. After postmortem, viscera of the deceased was taken and sent to Chemical Examiner, Kharar to determine the cause of death on 07.10.2014 but till date, in spite of reminders, report has not been sent by the Chemical RAVINDER SINGH 2015.10.13 13:56 I attest to the accuracy and authenticity of this document

-2CWP No.21759 of 2015 Examiner. Almost one year has already elapsed. I have considered the contentions raised by learned counsel for the petitioner.

The viscera was sent on 07.10.2014 but till date no report has been sent by the Chemical Examiner. A sufficient long time has elapsed. The report appears to have been delayed by respondent No.3. Respondent No.3 is directed to submit the report, if not already sent, to Senior Superintendent of Police, Bathinda, within a period of one month from the date of receipt of certified copy of this order. Disposed of.
