The petitioner has invoked the writ jurisdiction of this Court challenging sale notice dated 04.01.2015 issued by the bank in proceedings under Section 13 of the Securitisation and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002. CWP No.2177 of 2015 [2] Mr. Mahajan, learned counsel for the Bank states that offers for the sale of property, in dispute, were invited though e-tender on 10.02.2015. One Jyoti Khosla was the highest bidder who deposited 25% of the sale consideration on 10.02.2015 and balance 75% was deposited on 13.02.2015. Thereafter, the sale in favour of Jyoti Khosla was confirmed on 14.02.2015 by the authorised officer of the Bank. The order of the grant of stay by this Court was received by the Bank on 24.02.2015 i.e., after the confirmation of sale. Since sale stands confirmed, we do not find any reason to interfere in the process of sale in the exercise of writ jurisdiction. Accordingly, the writ petition is dismissed.
However, the petitioner is at liberty to avail such other remedy as may be available to him under the law.
