(Oral) The petitioner has approached this Court under Articles 226/227 of the Constitution of India, seeking quashing of the impugned order dated 14.08.2015 (Annexure P-3), passed by respondent No.4, whereby, the application for awarding for lesser punishment than the removal from service, which was awarded vide order dated 30.06.2009 has been declined. Besides above, a prayer for direction to respondent No.4 has also been made to pass a fresh speaking order keeping in view the order passed by this Court in CWP No. 17455 of 2014.

At the outset, learned counsel for the petitioner states that the order impugned in the present writ petition can be challenged before the Central Administrative Tribunal (in short 'the CAT'), however, the same has not been done. Accordingly, learned counsel for the petitioner states that he may be allowed to withdraw the present writ petition with liberty to the petitioner to approach the CAT by impugning the order dated 14.08.2015. 3.
Dismissed as withdrawn. It shall, however, be open for the petitioner to take recourse to remedies as may be available to him, in accordance with law.
