ARUN MONGA , J. (ORAL ) Prayer in the instant writ petition is for quashing of Inquiry Report dated 1.9.2017 (Annexure P6) and all subsequent proceedings arising therefrom, on the ground of mala fide on the part of respondent No.5 and the petitioner having been acquitted by the trial Court on the same set of charges, which order has been further upheld by the Hon'ble High Court in CRM-A-2035-MA--2016.

After arguing for some time, when this Court was not inclined to issue notice, learned counsel for the petitioner submits that he RAJ KUMAR ARORA 2019.07.22 10:43 I attest to the accuracy and integrity of this document

CWP-19370-2019 would be satisfied if the contentions raised in the writ petition are considered by respondent No.3 at the time of considering the Inquiry report and before passing of the appropriate disciplinary order. The writ petition is dismissed with an observation that respondent No.3 would objectively consider the contentions raised in the writ petition by treating the same as representation/objections against the Inquiry report and thereafter pass appropriate speaking order in accordance with law.
