NIDHI GUPTA, J. (ORAL) Prayer in this petition filed under Section 482 Cr.P.C. is for issuance of a directions to respondents No. 2 to 5 for conducting independent enquiry for cancellation of FIR No. 19 dated 28.04.2019 registered under Sections 376 and 506 IPC at Police Station Nandgarh, District Bathinda, lodged by respondent No. 7 with vague allegations. Petitioner in the present case is the father of accused in the aforesaid FIR.

On instructions from ASI Harminder Singh, learned counsel for respondent No. 1-State submits that the matter has been rendered infructuous, as the learned trial Court vide judgment dated 15.01.2020, had acquitted all the accused in a case arising out of FIR No. 19 dated 28.04.2019 registered under Sections 376 and 506 IPC at Police Station Nandgarh, District Bathinda.

CRM-M-30574-2019 -22024:PHHC:033491 Perusal of the file shows that on the last date of hearing the petitioner had gone un-represented. Even today also, there is no representation on behalf of the petitioner despite the case having been called twice.

In view of the above, this Court is left with no other option except to dispose of the present petition as having been rendered infructuous, with liberty to the petitioner to move an appropriate application within a period of 03 months from today for reviving the same, if so, advised.
