(Oral) The petitioner herein seeks the relief of regular bail in the criminal case arising out of the FIR bearing No.98 dated 02.07.2021 registered at Police Station Bicchore, District Nuh, under Sections 3/ 13 (1), 8/13 (3), 17 of the Haryana Gauvansh Sanrakshan and Gausamvardhan Act, 2015, with the allegations that he as well as his coaccused were found in possession of 180 kgs beef, 03 knives and 01 axe. Status-report filed on behalf of the respondent-State, by way of the affidavit of Deputy Superintendent of Police, Punhana, District Nuh, is already available on the file and the same is taken on the record. I have heard learned counsel for the petitioner as well as learned State counsel in the instant petition and have also perused the file thoroughly.

CRM-M No. 39203 of 2021 -2Learned counsel for the petitioner contends that the petitioner is in custody since the date of his arrest, i.e 02.07.2021 and is also not facing trial in any other criminal case of the similar nature and moreover, the Challan has already been presented in the Court and the charges have also been framed and in these circumstances, he (petitioner) deserves the relief as prayed for in this petition.

Learned State counsel does not dispute the afore-referred factual position.

Keeping in view the above-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Hajar Khan is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned.
