(Oral) The primary grievance of the petitioners in the present writ petition filed under Article 226 of the Constitution, is for directing the respondents to apply directions issued by this Court in CWP No. 11637 of 1996 and also policy letter dated 10.02.2010 (Annexure P-1), issued by respondent No.4.

Learned counsel for the petitioner submitted that a detailed and comprehensive representation dated 29th July, 2016, appended as Annexure P-5 has been filed with respondent No.3. However, decision may be taken thereon on individual basis after acknowledging the objections raised by the petitioners.

After hearing learned counsel for the petitioner and perusing the petition and without expressing any opinion on the merits of the case, we consider it appropriate to dispose of this writ petition by directing respondent No.3 at this stage, to decide the representation (Annexure P-5), within a period of two months from the date of receipt of certified copy of this order, after affording an opportunity of hearing and by passing a Jawala Ram 2016.10.17 13:55 I attest to the accuracy and authenticity of this document Chandigarh

It is, however, clarified that till the final decision on the representation dated 29th July, 2016 (Annexure P-5) is taken, status quo shall be maintained by the parties and one month thereafter as well. Needless to say, grant of status quo shall not be taken to be any expression of opinion on the merits of the controversy involved in the present writ petition.
