(ORAL) Learned counsel for the parties are ad idem that present writ petition is directed against an interim order passed by the appellate authority before whom statutory appeal filed on behalf of respondent No.4 is pending. Learned counsel for respondent No.4 submits that next date of hearing before the appellate authority is 18.10.2016. Learned counsel for the petitioner also fairly states that he has got no objection in case the appellate authority is directed to hear both the parties and decide the statutory appeal pending before it, at an early date or on the date already fixed, i.e. 18.10.2016.

Civil Writ Petition No. 22633 of 2014 In view of the abovesaid respective stands taken by learned counsel for the parties, present writ petition is disposed of with a direction to the Commissioner, Gurgaon Division, Gurgaon-respondent No.2, to grant reasonable opportunity of being heard to both the parties and thereafter, decide the appeal of respondent No.4, at an early date by passing an appropriate order, strictly in accordance with law, but in any case within a period of three months from the date of receipt of certified copy of this order.

The Commissioner, Gurgaon Division, Gurgaon-respondent No.2 shall also be at liberty to decide the appeal on the date already fixed, i.e. 18.10.2016.

Learned counsel for the parties have also stated that they shall not seek any adjournment on 18.10.2016 and shall ensure that respective arguments are addressed.

With the abovesaid observations made and directions issued, present writ petition stands disposed of.
