ANIL KSHETARPAL, J(Oral) Counsel for the petitioner contends that against the order dated 22.05.2018, no further petition has been filed in this Court. This court is of the considered opinion that there is no need to issue notice as the order being passed is innocuous and does not adversely affect the rights of the parties.
Proceedings under Sections 145 and 146 of the Code of Civil Procedure were initiated and receiver was appointed vide order dated 10.04.2018. In revision, the aforesaid order has been set aside by the learned Additional Sessions Judge, Gurdaspur, vide order dated 22.05.2018. The prayer made in the present petition is to issue appropriate directions to the Sub Divisional Magistrate, Gurdaspur, to restore possession of the properties handed over to receiver vide order dated 10.04.2018. Petitioner also asserts that it has already filed an application, Annexure P-3, before the Deputy Commissioner, Gurdaspur with the similar prayer.

Civil Writ Petition No.15701 of 2018 -2Keeping in view the prayer made, the Sub Divisional Magistrate, Gurdaspur, respondent no.3, is directed to decide the representation dated 31.05.2018 (Annexure P-3), which is alleged to have been marked to him by the Deputy Commissioner, Gurdaspur, within a period of one month from the date of receipt of a certified copy of this order.
Needless to say that if the order dated 22.05.2018 has been stayed by the Court, the Sub Divisional Magistrate, Gurdaspur, would be bound to act in accordance with the interim order. The writ petition is disposed of.
