Learned counsel for the appellants has stated that part payment has already been made as per the compromise and, hence, the present appeal has since been rendered infructuous.

In view thereof, the present appeal is dismissed as having rendered infructuous. Pending applications, if any, also stand disposed off. 4.

Needless to say, that the appellants would always be at liberty to get the present appeal revived in case the compromise does not go through.
