RAJIV SHARMA, J. (ORAL) The petitioners are Matriculate. They are aggrieved by the qualification prescribed in Annexure P1, whereby the applications are invited by the Haryana Staff Selection Commission for filling up 1100 posts of Canal Patwari and minimum prescribed qualification as per Advertisement is a Graduate or its equivalent. The case of the petitioners, in nutshell, is that previously the maximum qualification was Matriculation. CWP-19897-2019 petitioners has drawn the attention of the Court to the Punjab Public Works Department (Irrigation Branch) Patwaris' State Service, Class III, Rules, 1955 (for short "the Rules of 1955")(Annexure P3), whereby the minimum qualification for appointment to the post of Canal Patwari was Matriculation or School Leaving Certificate Examination of a recognised university or its equivalent but preference was given to candidates possessing higher qualifications. Rules of 1955 have been repealed by the Rules of the Haryana Irrigation and Water Resources Department Revenue Establishment Service (Group C) Rules, 2019, whereby the minimum essential qualification in the case of Canal Patwari - 100% by direct recruitment is Graduate or its equivalent examination from a recognised university.
