Ram Singh v. State Of Haryana & Others
IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH
Civil Writ Petition No.21001 of 2016.
Date of Decision: October 06, 2016 Ram Singh ......Petitioner versus State of Haryana and others .....Respondents CORAM: HON'BLE MR.JUSTICE SURYA KANT.
HON'BLE MR.JUSTICE SUDIP AHLUWALIA.
*** Present: Mr.Sachin Mittal, Advocate, for the petitioner. Mr.R.D.Sharma, DAG, Haryana, for respondent Nos.1 to 3. -.- Surya Kant, J . (Oral) Notice of motion to respondent Nos.1 to 3 only at this stage. On our asking, Mr.R.D.Sharma, learned Deputy Advocate General, Haryana, accepts notice on their behalf. Let three copies of the writ petition be supplied to learned State counsel during the course of day failing which this order shall be automatically recalled and the writ petition shall be deemed to have been dismissed for non-prosecution.
In view of the nature of order which we propose to pass, it is not necessary to seek any counter-reply from respondent Nos.1 to 3 or to serve respondent No.4 at this stage as no order prejudicial to their interest is being passed.
The grievance of the petitioner in the instant writ petition is that full amount of compensation alongwith interest and other statutory benefits has not been disbursed by the respondents as per the Award dated 12.01.2015 passed by the Reference Court.

CWP No.21001 of 2016 [2] It appears that in the cases of some other land-owners, the compensation amount has been further enhanced by this Court vide order dated 27.05.2016 in RFA No.5316 of 2014 (Pushpender Kumar and others versus State of Haryana and others) and other connected appeals though the Regular First Appeal preferred by the petitioner is still pending. Be that as it may, the petitioner is entitled to be paid compensation as has been awarded by the Reference Court. Since it is not known whether or not he has filed Execution Petition, we direct the respondents that due amount of compensation be deposited with the Executing Court within two months from the date of receiving a certified copy of this order, so as to enable that Court to disburse the same to the petitioner and/or other claimants.
Ordered accordingly.
