*** Present: Mr.Hemant Saini, Advocate, for the petitioner. -.- Surya Kant, J . (Oral) The petitioner-Company alleges that a part of its land has been utilized by the respondent-HUDA authorities for carving out plots allotted to the successful allottees in a draw of lots for Sector-77, Faridabad. Some of the allottees have been impleaded as party-respondents and it is averred that plot Nos.78 to 81-P allotted to them are actually carved out on the petitioner's land.

It is further alleged that the petitioner's land has neither been acquired nor compensation paid.

Having heard learned counsel for the petitioner and keeping in view the fact that the writ petition involves factual issues which can be effectively resolved after carrying out demarcation at the site in the presence of the parties, we dispose of this writ petition with the direction to the Administrator, Haryana Urban Development Authority, Faridabad to carry out demarcation after notice to the petitioner and other affected persons and determine the above-mentioned claim of the petitioner in accordance with Mohinder Kumar Kamboj 2016.10.19 17:01 I attest to the accuracy and integrity of this document Chandigarh law. It is, however, made clear that no allotment in favour of respondent

CWP No.21013 of 2016 [2] Nos.7 to 13 shall be cancelled and it shall be the responsibility of HUDA authorities to ensure that each allottee being successful in draw of lots, gets the plot.

Since we have not called upon the respondents at this stage, this order shall not be taken as an expression of opinion on the merits of the claim.

Let the needful be done within a period of two months from the date of receiving a certified copy of this order. Ordered accordingly.
