*** The grouse of petitioner Ram Niwas, working as JBT/PRT in Government Primary School, Garhi Jattan, District Karnal is that despite being duly eligible having requisite seniority, he is not being promoted to the post of TGT English or TGT Sanskirt rather one Manoj Kumarrespondent No. 3, who is junior to him has since been promoted as such vide order dated 2.8.2018 w.e.f. 17.7.2018. The petitioner is challenging the said order and seeks promotion with effect from the date when Manoj Kumar was promoted.
According to him, he had represented to the department by submitting representation dated 18.4.2022 (Annexure P-17) and had even got served a legal notice dated 21.4.2022, copy of which is Annexure P-18 but that did not evoke any response, as such he had to file the present writ petition.
Learned State counsel appearing for respondents No. 1 and 2 states that the legal notice got served by the petitioner upon the respondents would be disposed of expeditiously as per rules. PARVINDER SINGH 2022.08.18 17:34 I attest to the accuracy and authenticity of this order/judgment
CWP No. 17885 of 2022 Accordingly, the writ petition is disposed of finally directing respondents No. 1 and 2 to consider the legal notice got served by the petitioner upon respondents No. 1 and 2 in accordance with law, rules, regulations and instructions on the subject within a period of two months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed, which be conveyed to the petitioner. If the petitioner feels dissatisfied after passing of the order then he may take recourse to legal remedy in accordance with law. (H.S.
