Prayer in this petition, filed under Section 482 of the BNSS, 2023 (earlier Section 438 Cr.P.C.), is for grant of anticipatory bail to the petitioner, who has been booked in a criminal case arising out of First Information Report, as detailed hereunder:- Name of petitioner FIR No.

During investigation, on 28.03.2026, Investigating Officer was scrutinising the CCTV footage installed in village Rajomajra and at that time, one reliable secret informer came and informed that theft of Rs.21,800/- from the liquor vend has been committed by the accused namely Joginder Singh and Sukhbir Singh Bathal. After the arrest, during investigation on 28.03.2026, accused Joginder Singh got recorded his disclosure statement that he and his associate Sukhbir Singh Bathal had come in a Swift Dzire car No.PB-10EY-3707 and thereafter committed theft of Rs.21,800/- from the cash box. Accordingly Sukhbir Singh Bathal son of Balwant Singh was also nominated in the present case. Thereupon by recording the statement of Ex. Sarpanch Nachhatar Singh on 29.03.

2026, it was concluded that, in fact, actual name of Sukhbir Singh Bathal is 'Satvir Singh' (petitioner herein) and, therefore, counsel for the petitioner argues that only for the reason that named accused Sukhbir Singh Bathal could not be arrested, petitioner was already known to the police officials, because he was involved in six other cases and thus, has been made as accused in the present case as well. 4.

Since there appears to be question of identity of accused and one of the main accused Joginder Singh has already been arrested, prayer for anticipatory bail is allowed and petitioner is directed to join the investigation within two weeks from today or as and when required to do so and abide by all the terms and conditions laid down under Section 482(2) of BNSS, 2023. In the event of arrest, the petitioner shall be released on bail, subject to furnishing bail bonds to the satisfaction of the Arresting Officer. The petitioner shall also abide by all the conditions laid down under Section 438(2) Cr.P.C.

Besides, it is directed that petitioner would hand over his passport to the Investigating Agency or to Court concerned, if he possesses. Otherwise, would submit an affidavit, disclosing the fact that he does not possess any passport.

Accordingly, petition stands disposed of.
