This petition has been filed under Section 528 BNSS (482 Cr.P.C.) for quashing the impugned order dated 09.12.2025 (Annexure P-1) passed by Ld. Judicial Magistrate Ist Class, Phillaur whereby petitioner has been declared as Proclaimed person in FIR No.65 Dated 10.04.2023 u/s 323, 324, 34 and 201 (added later on) of IPC (115(2), 118, 3 (5), 238 of BNS at PS GRP Ludhiana, GRP, Punjab.

Learned counsel for the petitioner submits that due to nonservice, the petitioner could not appear before the learned trial Court on the date fixed. Consequently, he was declared as Proclaimed person vide order dated 09.12.2025. Learned counsel for the petitioner further submits that the petitioner is ready and willing to join the proceedings before the Court and prays that the impugned order be set aside.

In view of the limited prayer made by the petitioner, this Court does not find any legitimate ground to interfere in the impugned order dated 09.12.2025 passed by Ld. Judicial Magistrate Ist Class, Phillaur. However, in case the petitioner surrenders before the trial Court within next 07 working days from today and moves an application for grant of regular bail, the same shall be considered and decided by the Court concerned within a period of three days.

The petition stands disposed of.
